Microsoft aanklagen.

Heeft een klant die bijvoorbeeld getroffen werd door een virus of een worm
ooit wel eens een rechtzaak aangespannen wegens niet goed (lees lek)
werkende server software van Microsoft ?
Is het zowieso mogelijk, of wordt dit in de eula van Microsoft teniet gedaan ?
Wat ik niet geod begrijp is dat er heel veel over microsoft wordt geklaagt, of
het nou security is of wat dan ook.
Wat ik echter mis zijn rechtzaken van klanten tegen Microsoft.
Of gebeurt dit soms achter de schermen?

Volgens mij heeft microsoft toch wel veel in de rechtbank
gestaan, maar daar zulen ze wel speciale mensen voor hebben
om dat te doen.

Een leuk stukje:

Microsoft and its suppliers provide the Product and
support services (if any) AS IS AND WITH ALL FAULTS, and
hereby disclaim all other warranties and conditions, either
express, implied or statutory, including, but not limited
to, any (if any) implied warranties, duties or conditions
of merchantability, of fitness for a particular purpose,
of reliability or availability, of accuracy or completeness
of responses, of results, of workmanlike effort, of lack
of viruses, and of lack of negligence, all with regard to
the Product, and the provision of or failure to provide
support or other services, information, software, and
related content through the Product or otherwise arising
out of the use of the Product.

Aangezien je hiermee accoord bent gegaan (anders mag je windows niet gebruiken) heb je geen poot meer om op te staan. Overigens is MS hier niet de enige in die dat doet. Kijk maar eens goed naar de licenties van andere producenten.

Je bent niet de
enige die dat niet helemaal kan plaatsen. Er zijn meer dan
genoeg andere alternatieven waardoor ik er de noodzaak niet
van in zie.

Probeer maar eens aan te tonen dat het aan de Microsoft
software ligt, en niet aan de onkunde van de beheerder.

Along with the standard computer warranty agreement which
said that if the machine
1) didn't work,
2) didn't do what the expensive advertisement said,
3) electrocuted the immediate neighbourhood,
4) and in fact failed entirely to be inside the expensive
box when you opened it, this was expressly, absolutely,
implicitly and in no event the fault or responsibility of
the manufacturer, that the purchaser should consider himself
lucky to be allowed to give his money to the manufacturer,
and that any attempt to treat what had just been paid for as
the purchaser's own property would result in the attentions
of serious men with menacing briefcases and very thin watches.

Crowley had been extremely impressed with the warranties
offered by the computer industry, and had in fact sent a
bundle Below to the department that drew up the Immortal
Soul agreements, with a yellow memo form attached just
saying: "Learn, guys."
