WASHINGTON, D.C. – Today, House Judiciary Committee Chairman Jim Jordan (R-OH) sent letters to ten technology companies—including Alphabet, Amazon, Apple, Meta, Microsoft, OpenAI, Reddit, Rumble, TikTok, and xAI—reiterating that the Committee's document subpoenas (https://judiciary.house.gov/media/press-releases/chairman-jordan-subpoenas-big-tech-information-foreign-censorship-american) require the companies to produce communications with foreign censors, including the European Commission and European Union (EU) Member States.

The subpoenas are necessary to allow companies to disclose documents to the Committee without interference by foreign governments. Since the subpoenas were issued, the technology companies have produced to the Committee thousands of internal documents and communications with the European Commission and EU Member States pursuant to the Committee's subpoenas.

According to recent reporting, in response to fears about accountability from the United States, Prabhat Agarwal, the head of the European Commission's enforcement team for the Digital Services Act (DSA), told a group of European regulators that his colleagues have "started sending messages via . . . an encrypted app, rather than email, and many now have messages set to auto-delete, with the 'auto-delete timings getting shorter.'"

In light of this reporting, the Committee has reiterated that its subpoenas to the technology companies are "continuing in nature" and require the companies to preserve and produce relevant communications, including these auto-deleting messages, with foreign censors.

Aangezien president Trump steeds herhaalt dat hij de komende presidentsverkiezingen alleen kan verliezen als er gefraudeerd wordt, en veel te veel VS-burgers met wapens rondlopen (vooral de meer fanatieke aanhangers van Trump), vind ik het onverstandig om er blindelings vanuit te gaan dat Trump zal winnen of dat zijn aanhangers, zonder slag of stoot, zijn verlies zullen accepteren.

Wellicht zijn we te druk met Brexit, Corona en globale handelsoorlogen of weigeren we dit überhaupt als een mogelijk risico te accepteren. Waarschijnlijk ben ik aan de late kant met deze vraag: wat zou het meest zwarte scenario voor de beschikbaarheid van internet, Amerikaanse clouddiensten (services en onze informatie) en bijv. GPS kunnen zijn?

Zijn we voor onze ICT te afhankelijk van giganten als Microsoft, Amazon, Google, Apple en Oracle, maar ook organisaties zoals IANA en IETF? Of kunnen Europese vestigingen van die bedrijven en organisaties redelijk blijven doordraaien en taken overnemen bij chaos in VS-vestigingen? Denk ook aan continuiteit van digitale certificaten, beveiligingsupdates en dergelijke. En aan hybrid-cloud oplossingen waarbij leveranciers onderling verschillende standpunten innemen en afnemers dwingen partij te kiezen of op te zouten.

Hier ga ik als ik meer tijd heb, eens even lekker voor zitten om allemaal weer door te nemen, om een meer inhoudelijke reactie te schrijven, maar goed dat je die discussie uit oktober 2020 verwijst. Die ga ik eerst herlezen! Geopolitieke situatie en de hoek waarvan de politieke wind waari is gedraaid, dus mooi inhoudelijk overzichtstopic over ontwikkelingen van de laatste jaren.
